1. General Provisions
1.1. This Offer is the official proposal of TM “Arturela” (hereinafter — Seller) to conclude a distance sales contract via the online store https://arturela.com (hereinafter — Online Store, Agreement).

1.2. The moment of full and unconditional acceptance of this Offer (acceptance) by the Buyer shall be considered the payment of the order under the terms of this Agreement.

2. Terms and Definitions

  • Goods — models, accessories, components and related items;

  • Online Store — a means of selling goods through an electronic transaction in accordance with the Law of Ukraine “On E-Commerce”;

  • Seller — the company offering goods presented on the Website;

  • Buyer — an individual who has entered into this Agreement with the Seller;

  • Order — the Buyer’s selection of certain items from the list of goods and their payment.

3. Subject of the Agreement
3.1. The Seller undertakes to transfer the Goods to the Buyer, and the Buyer undertakes to pay for and accept the Goods under this Agreement.

3.2. This Agreement governs:

  • voluntary selection of goods by the Buyer;

  • independent order placement;

  • payment by the Buyer;

  • processing and delivery of the Order.

4. Order Placement Procedure
4.1. The Buyer may place an order for any goods available on the Website.
4.2. Each item may be ordered in any quantity.
4.3. If the goods are not available, the Seller shall inform the Buyer (by phone or email).
4.4. In case of unavailability, the Buyer may:

  • replace the goods with an analogous item;

  • refuse the goods;

  • cancel the Order.

5. Payment Procedure
5.1. Payment is made in UAH:

  • via LiqPay (cashless payment);

5.2. Payment options:

  • full prepayment of the order;

5.3. If payment is not received, the Seller reserves the right to cancel the Order.

6. Delivery Terms
6.1. Delivery is carried out by transport companies to their warehouses.
6.2. Along with the Order, the Buyer receives documents in accordance with the laws of Ukraine.

7. Rights and Obligations of the Parties
The Seller has the right to:

  • suspend the provision of services in case of Buyer’s violation of this Agreement.

The Buyer undertakes to:

  • pay for and collect the Order on time.

The Buyer has the right to:

  • place an Order;

  • conclude an electronic Agreement;

  • demand fulfillment of the Agreement.

8. Liability of the Parties
8.1. The Parties shall be liable in accordance with this Agreement and the current legislation of Ukraine.
8.2. The Seller shall not be liable for:

  • changes in the product’s appearance made by the manufacturer;

  • minor discrepancies in color due to individual monitor settings;

  • accuracy of the Buyer’s information;

  • delays or failures in delivery caused by factors beyond the Seller’s control.

8.3. The Buyer is responsible for actions carried out on the Internet under their account.
8.4. In case of force majeure, the Parties are released from liability.

9. Other Terms

  • The Seller may amend this Agreement by publishing the updated version on the Website.

  • The use of the Website for browsing or placing an Order is free of charge.

  • By placing an Order, the Buyer consents to the processing of their personal data in accordance with the Law of Ukraine “On Personal Data Protection”.

10. Return of Goods of Proper Quality
10.1. Returns shall be carried out in accordance with the laws of Ukraine.
10.2. Return costs shall be borne by the Buyer.
10.3. The Seller shall refund the cost of the goods minus delivery expenses.

11. Term of the Agreement
11.1. The Agreement is considered concluded from the moment of acceptance by the Buyer.
11.2. It may be terminated by mutual consent before delivery.
11.3. It may be unilaterally terminated in cases provided by law.
